PATENT RIGHTS DEFENSES
IN THE CONTEXT OF THE DEVELOPMENT
OF THE CODIFICATION OF INTELLECTUAL
PROPERTY LEGISLATION

The article analyzes the genesis of the mechanism of patent rights defensing in the postperestroika
period. The author compares the relevant provisions of the 1992 Patent Law,
the first and current version of Part Four of the Civil Code of the Russian Federation.
She proves that the key destination of transformation of the defense mechanism in the
framework of the civilian reform, on the one hand, is the clarification of the boundaries
of exclusive rights to patent protected objects, on the other, – development of the
effective system of measures to protect violated rights. Moreover, the second goal has
not yet been fully resolved. The author has identified a number of problematic issues,
gaps related to imposing liability measures on the violator, and the use of other remedies.
A number of proposals have been formulated for the further development of legislation
and judicial practice.
