CASES OF FREE FAIR USE OF COPYRIGHT OBJECTS:
SUMMARY, OVERVIEW

In the article, the authors analyze the problems associated with exceptions to
copyright. They consider the conditions and criteria for delimiting the cases of free
fair use (including legitimate citation, illustration, reproduction for private uses)
from copyright infringements. The authors assess the prospects for integration into
the Russian legal discourse of sophisticated Western law enforcement approaches to
ensure a balance of interests between copyright holders and users of copyright objects,
society as a whole; application of multifactorial tests in copyright infringement cases;
expanding the boundaries of copyright based on fundamental rights and freedoms. The
authors substantiate the necessity of transforming the system of boundaries of exclusive
rights to copyright objects taking into account “digital calls”.
