О новеллах в судебной практике по вопросам самовольного строительства

В настоящей статье, автор комментирует основные правовые позиции Постановления Пленума ВС РФ и Пленума ВАС РФ от 29 апреля 2010 г. № 10/22 «О некоторых вопросах, возникающих в судебной практике при разрешении споров, связанных с защитой права собственности и других вещных прав», связанные с проблемами самовольного строительства. Целью статьи является практический анализ положений Постановления, требующих осмысления с точки зрения возможных вариантов их толкования.

In this article, the author comments on the basic legal position of the Resolution of the Plenary Assembly of Supreme Court and the Supreme Arbitration Court of the Russian Federation from April 29, 2010 № 10/22 “On some issues arising in judicial practice in resolving disputes relating to the protection of property rights and other rights” dealing with the problems of unauthorized construction. The aim of the paper is a practical analysis of the provisions of the Resolution requires apprehension in terms of possible options for their interpretation.
