THE SYSTEM OF GENERAL PROVISIONS OF LAW
OF OBLIGATIONS: LEGISLATIVE LOGIC
AND DOCTRINAL DESTINY

The author refers to problems of the systematics of norms that make up subsection 1 of
section III of the Civil Code “General Provisions on Obligations”. The goal is to attract
scientific attention to the discussion of the existing theoretical model of law of obligations.
The author examines the history of the formation of general provisions of the legislation
on obligations, as well as fundamental ideas on the basis of which the content of norms
that make up general provisions on obligations was carried out. In terms of posing the
problem, certain issues of the systematics of general norms are analyzed, which, in the
opinion of the author, should become the subject of doctrinal attention.
