Борьба за залог: третий этап реформы залогового права России

В статье разбираются новеллы российского залогового права, введенные в действие с 1 июля 2014 г. Анализируется их связь с предшествующим регулированием и судебной практикой. Автор разбирает возможные проблемы, с которыми могут столкнуться участники гражданского оборота при применении новых норм залогового права, и предлагает пути их решения.

Battle for the Law of Real Security: The Third Step in Reforming Russian Pledge Law

The paper is dealing with the last reform of the Russian pledge law that was entered into force on July 1, 2014. It contains the analysis of the routes and sources of the reform, particularly their liaison with the previous legislation and case law. The author examines the possible difficulties of interpretation and application of the new pledge law which the economic actors may face with and offers the ways for their resolution.
