Вниманию читателей предлагаются два основных решения из практики немецкого высшего суда по совершению сделок через онлайн-платформы, позволяющие – в условиях, когда зарубежные высшие суды редко обращаются к этой проблематике, – составить представление о тех проблемах, с которыми столкнется судебная практика по данного рода спорам.

The present materials contain translations of two momentous cases tried by the German Supreme Court concerning dealings via online platforms. These translations, given the typical rarity of supreme courts’ opinions on the matter, allow an interesting insight into issues that any courts would face by trying such cases.
