Настоящая статья посвящена исследованию публичных недвижимых вещей в различных правопорядках. Слово «частное» в названии работы отсылает к исследованию взаимодействия частноправовых и публично-правовых институтов между собой. Концептуальная проблема, ставшая предпосылкой настоящего исследования, заключается в ответе на вопрос: чем являются все те недвижимые вещи, существующие на стыке публичного и частного права? Вдохновением при написании работы послужило социологическое исследование, проведенное в одном из российских городов. Иллюзорные представления горожан были далеки от реального положения дел: те вещи, что они воспринимали как «общие», на деле оказываются тем, что мы называем «публичный домен». С юридической точки зрения это две абсолютно разные категории, что, безусловно, влияет на возможность и границы использования таких вещей.
