В ГРАЖДАНСКОМ ПРАВЕ:
В ПОИСКАХ ОПТИМАЛЬНОГО РЕШЕНИЯ*

В статье рассматривается вопрос о том, должно ли содержание вины в гражданском праве во всех случаях быть структурировано одинаковым образом или же с теоретической и практической точки зрения предпочтителен подход, при котором вина от случая к случаю может иметь разное содержание. По результатам анализа различных концепций вины обосновывается, что гражданско-правовая вина должна включать в свое содержание поведение лица (поведенческую составляющую) и его психическое отношение (психическую составляющую), которые не соответствуют стандарту осмотрительного лица, также состоящему из двух взаимосвязанных элементов: поведенческого и психического. Продемонстрировано, что аналитическое обособление пове- денческой составляющей вины при определенных условиях позволяет сохра- нить те практические преимущества, которыми обладает исключительно поведенческая неосторожность.

THE CONTENT OF FaUlT
IN CIVIL LAW:
IN SEARCH OF AN OPTIMAL SOLUTION

The paper considers the question of whether the content of fault in civil law should be structured in the same way for all situations, or from a theoretical and practical point of view, an approach is preferable under which fault may have different content from case to case. Based on the results of the analysis of various concepts of fault, it is proved that civil fault should include in its content the behavior of a person (behavioral component) and his state of mind (mental component), which do not meet the standard of a prudent person, also consisting of two interrelated elements: behavioral and mental. Further, it is demonstrated that the analytical isolation of the behavioral component of fault under certain conditions allows to preserve the practical advantages that behavioral negligence has.
