В ИСТОРИЧЕСКОЙ И СРАВНИТЕЛЬНО-ПРАВОВОЙ ПЕРСПЕКТИВЕ

В статье рассматриваются основания и порядок сноса самовольной постройки в российском и иностранном правопорядках, в том числе в исторической перспективе. Автор приходит к выводу, что снос является крайней мерой ответ- ственности. Однако разные страны по-разному подходят к установлению баланса интересов между лицами, вовлеченными в процесс сноса.

ACTION FOR DEMOLITION OF AN UNAUTHORIZED CONSTRUCTION IN HISTORICAL AND COMPARATIVE LEGAL PERSPECTIVE

The article discusses the grounds and procedure of demolition of an unauthorised construction in the Russian and foreign legal systems, including the historical perspective.The author concludes that demolition is a responsibility of last resort. However, different countries have different approaches to balancing the interests of the parties involved in the demolition process.
