ПРИ РЕОРГАНИЗАЦИИ: ОПТИМАЛЬНАЯ МОДЕЛЬ

Необходимость особой защиты кредиторов при реорганизации требует обоснования, которое в российском праве никогда специально не анализировалось. Целью исследования было установить, насколько, в каком объеме и когда такая защита должна предоставляться. Статья на основании сравнительно-правового метода раскрывает основания такой защиты в европейских правопорядках и сопоставляет это с отечественным регулированием. В результате исследования делается вывод о том, что кредиторы подлежат защите только при наличии ущерба от реорганизации.
